Terms of Service

These terms govern your use of the MuLab app and mulab.in (the "Service"), operated by MuLab Technology Limited ("MuLab", "we", "us"). By creating an account or using the Service, you agree to them.

1. Acceptance & eligibility

  • You must be at least 13 years old (or the higher minimum age in your jurisdiction) and legally able to enter into these terms.
  • If you do not agree to these terms, the Privacy Policy, and the Community Guidelines, do not use the Service.

2. Your account

  • Provide accurate information when registering, and keep it up to date.
  • You are responsible for your account and everything that happens under it. Keep your credentials secure and tell us immediately at info@mulab.in if you suspect unauthorised use.
  • Each account must be tied to one email address or sign-in identity. You may have more than one account if you use different sign-in methods, but you must not impersonate others or misrepresent your affiliation with any person, brand, or retailer.

3. Your content

You own what you post. Reviews, signal chains, sound scores, photos, comments, and other content you publish ("Your Content") remain yours.

By posting, you grant MuLab a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, adapt (e.g. resize images, translate), and distribute Your Content within and to promote the Service, and to derive aggregated, anonymised insights from it — for example, product feedback summaries and setup statistics that may be shared with audio gear brands. Such insights never identify you; see the Privacy Policy for details.

  • You are solely responsible for Your Content and warrant that you have the rights to everything you post, that it complies with applicable law, and that it does not infringe any third-party rights, including copyright, trademark, privacy, or publicity rights.
  • This licence ends when you delete Your Content or your account, except for content already shared with others within the Service, aggregated insights already produced, and copies we must retain for legal purposes.

4. Acceptable use

When using the Service you must follow the Community Guidelines, which form part of these terms. In addition, you must not:

  • Post content that is unlawful, infringing, deceptive, or harmful;
  • Impersonate any person or entity, or post reviews for compensation without disclosure;
  • Scrape, harvest, or bulk-download data from the Service, or access it by automated means without our written permission;
  • Interfere with, disrupt, reverse-engineer, or attempt to gain unauthorised access to the Service;
  • Use the Service to promote counterfeit products or off-platform scams.

5. Moderation & enforcement

  • We may review, remove, or restrict content that violates these terms or the Community Guidelines, and may warn, suspend, or terminate accounts for violations.
  • You can report content or users in the app, and block users you do not want to interact with.
  • If we take action against your content or account, you may appeal by emailing info@mulab.in.

6. MuLab's intellectual property

The Service — including the MuLab name and logo, the app and website, the gear library, and the six-axis sound evaluation framework — is owned by MuLab or its licensors and protected by intellectual property laws. Except for the rights expressly granted to you, no licence is given. Third-party brand names and logos shown in the gear library belong to their respective owners and are used for identification only; their appearance does not imply endorsement.

7. Store & future purchases

Commerce features (such as an in-app gear store) are not yet available. When they launch, additional terms — covering orders, payment, shipping, and returns — will be presented to you before you make any purchase, and will apply alongside these terms.

8. Disclaimers & limitation of liability

  • The Service is provided "as is" and "as available". We do not warrant that it will be uninterrupted, error-free, or that any content is accurate. Reviews and scores reflect individual users' subjective listening impressions, not MuLab's views or professional advice — purchasing decisions are your own.
  • To the maximum extent permitted by law, MuLab shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service.
  • To the maximum extent permitted by law, MuLab is not responsible for purchase decisions, product expectations, or losses that arise from relying on user-generated content.
  • To the maximum extent permitted by law, MuLab is not responsible or liable for unlawful, infringing, or otherwise illegal user-generated content posted by users. You agree to indemnify MuLab against any claims, losses, liabilities, damages, costs, or expenses arising from Your Content or your breach of these terms.
  • Nothing in these terms excludes liability that cannot be excluded under applicable law.

9. Termination, governing law & changes

  • You may stop using the Service and delete your account at any time (see the Privacy Policy for what happens to your data).
  • We may suspend or terminate the Service or your access to it for violations of these terms, legal requirements, or discontinuation of the Service, with reasonable notice where practicable.
  • These terms are governed by the laws of the Hong Kong Special Administrative Region, and the courts of Hong Kong have exclusive jurisdiction, subject to any mandatory consumer protections in your place of residence.
  • We may update these terms; for material changes we will give you advance notice in the app or by email. Continued use after the effective date constitutes acceptance.

10. App store terms

If you download the app from the Apple App Store or Google Play, the following also apply:

  • These terms are between you and MuLab only — not with Apple Inc. or Google LLC. Apple and Google are not responsible for the Service or its content, and have no obligation to provide maintenance or support.
  • Apple and Google (and their subsidiaries) are third-party beneficiaries of these terms and may enforce them against you.
  • Your use must also comply with the applicable App Store / Google Play terms of service, including usage rules.

本條款規範你對 MuLab 應用程式及 mulab.in（合稱「本服務」）的使用。本服務由妙樂科技有限公司（英文名稱：MuLab Technology Limited，下稱「MuLab」、「我們」）營運。建立帳戶或使用本服務即表示你同意本條款。

1. 接受條款與資格

  • 你必須年滿 13 歲（或你所在司法管轄區規定的更高年齡），並具備訂立本條款的法律行為能力。
  • 如你不同意本條款、私隱政策及社群守則，請勿使用本服務。

2. 你的帳戶

  • 註冊時請提供準確資料，並保持更新。
  • 你須對你的帳戶及其下的一切活動負責。請妥善保管登入資料；如懷疑帳戶被未經授權使用，請立即電郵 info@mulab.in 通知我們。
  • 每個帳戶須綁定一個電郵地址或登入身份。你可以因使用不同登入方式而擁有多於一個帳戶，但不得冒充他人，或虛報你與任何人士、品牌或零售商的關係。

3. 你的內容

你發佈的內容屬於你。你發佈的評測、器材鏈、聲音評分、相片、留言及其他內容（「你的內容」）之擁有權仍歸你所有。

發佈內容即表示你授予 MuLab 一項全球性、非專屬、免版稅的授權，允許我們在本服務範圍內及為推廣本服務寄存、儲存、重製、展示、改編（例如調整圖片大小、翻譯）及發佈你的內容，並可從中產生匯總、匿名化的洞察 — 例如可能與音響品牌分享的產品意見摘要及器材組合統計。該等洞察絕不會識別你的身份；詳情請參閱私隱政策。

  • 你須自行對你的內容承擔全部責任，並保證你對所發佈的一切內容擁有相關權利、該等內容符合適用法律，且不侵犯任何第三方權利，包括版權、商標權、私隱權或公開權。
  • 當你刪除你的內容或帳戶時，上述授權即告終止，惟已在本服務內與他人分享的內容、已產生的匯總洞察，以及法律要求保留的副本除外。

4. 可接受的使用方式

使用本服務時，你必須遵守社群守則（構成本條款的一部分）。此外，你不得：

  • 發佈違法、侵權、具欺騙性或有害的內容；
  • 冒充任何人士或機構，或在未披露的情況下發佈受酬評測；
  • 未經我們書面許可，抓取、收集或大量下載本服務的資料，或以自動化方式存取本服務；
  • 干擾、破壞、逆向工程或試圖未經授權存取本服務；
  • 利用本服務宣傳假冒產品或平台外騙局。

5. 內容審核與執行

  • 我們可審查、移除或限制違反本條款或社群守則的內容，並可就違規行為向帳戶發出警告、暫停或終止帳戶。
  • 你可在應用程式內檢舉內容或用戶，並封鎖你不想互動的用戶。
  • 如我們對你的內容或帳戶採取行動，你可電郵 info@mulab.in 提出申訴。

6. MuLab 的知識產權

本服務 — 包括 MuLab 名稱及標誌、應用程式及網站、器材資料庫，以及六維聲音評估框架 — 均屬 MuLab 或其授權人所有，受知識產權法律保護。除明文授予你的權利外，不授予任何其他授權。器材資料庫中顯示的第三方品牌名稱及標誌屬其各自擁有人所有，僅作識別用途；其出現不代表任何背書。

7. 商店與未來購買

商務功能（例如應用程式內器材商店）尚未推出。功能推出時，涵蓋訂單、付款、運送及退貨的附加條款將於你購買前向你展示，並與本條款一併適用。

8. 免責聲明與責任限制

  • 本服務按「現狀」及「現有」基礎提供。我們不保證服務不會中斷、沒有錯誤，或任何內容準確無誤。評測及評分反映個別用戶的主觀聽感，並非 MuLab 的觀點或專業意見 — 購買決定由你自行承擔。
  • 在法律允許的最大範圍內，MuLab 不就你使用本服務所產生的任何間接、附帶、特殊、後果性或懲罰性損害，或任何利潤、資料或商譽損失承擔責任。
  • 在法律允許的最大範圍內，MuLab 不就因購買決定、產品期望，或依賴用戶生成內容而產生的損失承擔責任。
  • 在法律允許的最大範圍內，MuLab 不就用戶發佈的違法、侵權或其他非法用戶生成內容承擔責任。你同意就因你的內容或你違反本條款而產生的任何申索、損失、責任、損害、費用或開支向 MuLab 作出彌償。
  • 本條款不排除依適用法律不可排除的責任。

9. 終止、適用法律與修訂

  • 你可隨時停止使用本服務並刪除帳戶（資料處理方式見私隱政策）。
  • 如你違反本條款、基於法律要求或本服務停止營運，我們可暫停或終止本服務或你的存取權，並在可行情況下給予合理通知。
  • 本條款受香港特別行政區法律管轄，香港法院具有專屬管轄權，惟不影響你居住地的強制性消費者保障。
  • 我們可能修訂本條款；重大變更將提前於應用程式內或以電郵通知你。生效日後繼續使用即視為接受。

10. 應用商店條款

如你從 Apple App Store 或 Google Play 下載應用程式，以下條款亦適用：

  • 本條款僅存在於你與 MuLab 之間 — 與 Apple Inc. 或 Google LLC 無關。Apple 及 Google 對本服務或其內容概不負責，亦無義務提供維護或支援。
  • Apple 及 Google（及其子公司）為本條款的第三方受益人，可向你執行本條款。
  • 你的使用亦須遵守適用的 App Store / Google Play 服務條款，包括使用規則。

3. 你的内容

你发布的内容属于你。你发布的评测、器材链、声音评分、照片、评论及其他内容（"你的内容"）的所有权仍归你所有。

发布内容即表示你授予 MuLab 一项全球性、非排他、免版税的许可，允许我们在本服务范围内及为推广本服务托管、存储、复制、展示、改编（例如调整图片大小、翻译）及分发你的内容，并可从中生成汇总、匿名化的洞察 — 例如可能与音频品牌分享的产品反馈摘要及器材组合统计。这些洞察绝不会识别你的身份；详情请参阅隐私政策。

  • 你须自行对你的内容承担全部责任，并保证你对所发布的一切内容拥有相关权利、该等内容符合适用法律，且不侵犯任何第三方权利，包括版权、商标权、隐私权或公开权。
  • 当你删除你的内容或账户时，上述许可即告终止，但已在本服务内与他人分享的内容、已生成的汇总洞察，以及法律要求保留的副本除外。
